  1. Introduction
    Welcome to Baby Sleep Sounds & Music (the “App”), developed by Booster Design. By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.
  2. Safety Guidelines & User Responsibility
    The App is a tool to assist with sleep, but the safety of your child is your sole responsibility. You agree to adhere to the following safety protocols:
    • Volume Levels: You acknowledge that exposure to loud sounds for extended periods can damage hearing. We recommend keeping the volume at a safe, low level (similar to the sound of a soft shower). Do not place the device directly next to your baby’s ear.
    • Device Placement: NEVER place your mobile device inside the crib, bassinet, or bed with your baby. The device should be placed on a secure surface at a safe distance (at least 3 feet / 1 meter) from the baby to prevent risk of strangulation, overheating, or radiation exposure.
    • Airplane Mode: Since the App operates 100% offline, we strongly recommend switching your device to “Airplane Mode” (Flight Mode) while using the phone near an infant to minimize exposure to cellular and Wi-Fi signals. This ensures zero signal interference near your baby and prevents sudden notifications from disrupting sleep.
  3. Medical Disclaimer & Intended Use
    • Not a Medical Device: The App is not intended to diagnose, treat, cure, or prevent any medical condition (including but not limited to colic, insomnia, or sleep apnea). The App is for soothing and entertainment purposes only.
    • Consult a Professional: The content provided in the App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your pediatrician or qualified health provider with any questions you may have regarding your baby’s health or sleep patterns.
    • Age-Appropriate Usage: While we have curated sounds for specific developmental stages (0-2, 3-5, 6-12 months), these are general guidelines based on our research. You acknowledge that every baby is unique, and you are responsible for determining which sounds are effective and comfortable for your child.
    • No Guarantees: We do not guarantee that the App will induce sleep for every child. Every baby is unique, and results may vary.
    • Avoid Dependency: We recommend using the built-in Timer to fade sounds out once the baby is asleep. For older infants (3-6 months+), we suggest using the App primarily for the “falling asleep” phase to encourage self-soothing.
  4. Subscriptions and Payments
    • App Store Transactions: The App may offer paid features or subscriptions. These transactions are processed directly by the Apple App Store or Google Play Store. We do not store your credit card information.
    • Refunds: All refund requests must be directed to the store where you downloaded the App (Apple or Google) and are subject to their respective refund policies.
    • Free Trial: If you sign up for a free trial, you may be charged automatically at the end of the trial period unless you cancel 24 hours before the trial ends via Apple App Store or Google Play Store.
  5. Data Storage & Uninstallation (Important)
    • Local Storage Only: The App prioritizes your privacy by storing all data (including custom mixes, favorites, and settings) locally on your device. We do not store your data on cloud servers.
    • Permanent Data Loss: You acknowledge that uninstalling the App will permanently delete your data, including all saved mixes. Because we do not have access to your data, Booster Design cannot restore lost data under any circumstances.
    • Resetting Data: If you wish to clear your data without uninstalling, you may use the “Delete User Data” option in the App Settings.
  6. Intellectual Property
    All content, including sound recordings, mixtures, and interface designs, is the property of Booster Design. You are granted a limited license for personal use only. You may not record, resell, or redistribute the sounds found within the App.
  7. Limitation of Liability
    To the fullest extent permitted by applicable law, Booster Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
    • Any health issues or hearing damage resulting from improper use of the App (e.g., high volume or unsafe device placement).
    • Failure of the App to function (e.g., if the battery dies or the app crashes while the baby is sleeping).
    • Any loss of data resulting from uninstallation or device failure.
    • The App is provided “AS IS” and “AS AVAILABLE” basis without warranties of any kind.
  8. Governing Law
    These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ghaziabad, Uttar Pradesh, INDIA.
